Charnwood PSPO - Consultation Stage 2  - Formal stage of consultation for comment on the proposed changes in the Notice of Intention

Charnwood Borough Council would like to hear your comments about the proposed extension to the Public Spaces Protection Order (PSPO) which covers the whole Borough of Charnwood.

It is proposed to:

  • Merge the variation for Stonebow Washlands and Dishley Pool from May 2022 into the main order;

Syston Community Garden proposal

The Council is working with a Syston based community group Grow Give Live and Syston Town Council, to consider bringing unused greenspace along Glebe Way in Syston back into use.

The vision is to create a community garden as well as provide better access and opportunities for informal recreation. The community garden would produce food and accomodate organised activities linked to gardening and sustainability.

The Council ran a consultation to give local residents an opportunity to view and provide feedback on the proposals to create Syston Community Garden.

The consultation closed on Monday November 14.

Polling District Review 2022

A consultation was launched about proposed changes to polling districts, places and stations in Charnwood.

All 92 polling districts have been reviewed following changes to the borough’s ward boundaries which will come into effect for the local elections in May 2023.

Next year the current 28 ward boundaries in Charnwood will reduce to 24. The number of borough councillors will remain at 52 but it means most ward boundaries will change, except for two wards, Anstey, and Quorn & Mountsorrel. The boundary changes are the result of an independent review by the Boundary Commission.

Public consultation on the future of Mountsorrel Quarry

Tarmac is preparing a planning application for a northern and south-eastern extension to Mountsorrel Quarry in Leicestershire. They held a public consultation from 3 to 16 October 2022.

The consultation included a website as well as three in-person public exhibitions that gave people an opportunity to view the proposals, and submit feedback.

A planning application (including an Environmental Impact Assessment) is likely to be submitted to Leicestershire County Council in the new year.

Public Spaces Protection Orders Consultation

Charnwood Borough Council currently has a Public Spaces Protection Order (PSPO) in place which runs from January 2020 to January 2023.

The PSPO will need to be varied and/or extended in January 2023 as 3 years is the maximum time period for these orders in line with the Anti-Social Behaviour Crime and Policing Act 2014. The first part of varying/extending these orders will involve a consultation across the Borough.

There will also be a further consultation on Stonebow Washlands and Dishley Pool so that the variation made in May 2022 can be merged with the Borough wide Order.  There is a map included in the consultation details to show the proposed zones across the site at Stonebow Washlands.

The current orders cover:

  • Not allowing a dog to foul and not clearing up (across the whole Borough except private and agricultural land)
  • Dogs being excluded from fenced children’s play areas
  • Dogs being kept on a lead in certain area
  • Dogs being put on leads by direction of an authorised officer

The proposals in the consultation include maintaining the existing controls and also asking residents and other stakeholders if further controls may be considered. 

It is important to note that any additional controls will only be considered where there is clear evidence of significant ASB (anti-social behaviour) activities, for example dog attacks. There will also be an additional resource needed to enforce so historical data and evidence will be reviewed when making any decisions. It will also need to meet the legal test shown below.

Power to make orders

  1. A local authority may make a public spaces protection order if satisfied on reasonable grounds that two conditions are met.
  2. The first condition is that: a) activities carried on in a public place within the authority’s area have had a detrimental effect on the quality of life of those in the locality, or b) it is likely that activities will be carried on in a public place within that area and that they will have such an effect.
  3. The second condition is that the effect, or likely effect, of the activities: a) is, or is likely to be, of a persistent or continuing nature, b) is, or is likely to be, such as to make the activities unreasonable, and c) justifies the restrictions imposed by the notice.
  4. A public spaces protection order is an order that identifies the public place referred to in subsection (2) (“the restricted area”) and: a) prohibits specified things being done in the restricted area, b) requires specified things to be done by persons carrying on specified activities in that area, or c) does both of those things.
  5. The only prohibitions or requirements that may be imposed are ones that are reasonable to impose in order: a) to prevent the detrimental effect referred to in subsection (2) from continuing, occurring or recurring, or b) to reduce that detrimental effect or to reduce the risk of its continuance, occurrence, or recurrence.

  • Yellow zone = Dogs on leads by direction (It is the owner’s choice whether to keep dogs on a lead or not but they must be in full control of the dog.  If an authorised officer thinks your dog is out of control or likely to become out of control you will be asked to put your dog on a lead and failure to do so will result in a fine.
  • Blue zone = Dogs should be on a lead at all times.

The initial consultation to the public has now closed as of August 19. Stakeholders are being consulted until September 30, 2022.

After September 30, a review will take place and a Notice of Intention will be published on this website with proposals for varying and/or extending the Order.

Bradgate Park and Swithland Woods Public Spaces Protection Order Consultation to extend or extend and amend the existing controls (Stage 2)

Proposal for Order – 2023 – 2026

  • Yellow zone – dogs on leads between 9am and 10pm
  • Green zone – dogs on lead by direction (requirement to put dog on a lead if a Ranger or authorised officer thinks the dog is out of control or likely to become out of control)
  • Grey Zone – Deer sanctuary – dogs exclusion zone for safety of the deer (people are also excluded from this area)

Background

Bradgate Park and Swithland Woods extended the Public Spaces Protection Order (PSPO) for dog control in February 2020 to apply conditions about dog control on the estate.

Charnwood Borough Council made the order in line with legislation in the Anti-social Behaviour Crime and Policing Act 2014 .

The Order includes a:

  • dog on leads zone (yellow zone).
  • dog on lead by direction zone (green zone) which covers 75% of the estate (except for the deer sanctuary which is a)
  • dog exclusion zone (grey zone).

The Order lasts for up to three years, so in February 2023 it is proposed to continue with the PSPO for Bradgate Park and Swithland Woods in the same format as the Order in 2020. Detail at top of page.

Stage 1 of the consultation was open from Tuesday June 14, 2022 until Friday July 29 at 5pm.

Consultation on Licensing Act 2003 - Statement of Licensing Policy 2022-2027

Charnwood Borough Council is required under the terms of the Licensing Act 2003 to carry out a review of its Statement of Licensing Policy, which is used to determine all applications made under the terms of the Act, every five years.

The current Statement of Licensing Policy was approved in June 2017. All changes proposed in the Statement of Licensing Policy 2022 -2027 can be found in the consultation document found on the Consultation on Licensing Act 2003 - Statement of Licensing Policy 2022-2027 webpage.

The consultation ended on Friday March 18, 2022.

Tenancy agreement consultation

Please note: This consultation was only applicable to those tenants whose tenancies started between October 11, 2021 and March 14, 2022.

We have consulted tenants over a new tenancy agreement and asked to hear the views of both existing Charnwood secure and introductory tenants.

The existing tenancy agreement is now over ten years old and the service needs to update it in line with changes in the law, regulation and recognised good practice.

In order to replace the existing tenancy agreement with the new one, the service consulted tenants and considered any comments made about the proposed new agreement, before informing tenants of when the new agreement will take effect.

The consultation ended at noon on Monday April 11, 2022.

Public Spaces Protection Order (PSPO) Consultation – Variation to existing Order Stonebow Washlands and Dishley Pool

Charnwood Borough Council currently has a Public Spaces Protection Order (PSPO) in place which runs from January 2020 to January 2023. 

The current PSPO which covers this area includes the following restrictions:

  • Not allowing a dog to foul and not clearing up (across the whole Borough except private and agricultural land)
  • Dogs being put on lead by direction of an authorised officer

The proposals in the consultation include extending the existing controls to insist that dogs are kept on a lead at all times at Stonebow Washlands and Dishley Pool.
